1.    General provisions

1.1.    The present Procedure for consideration of investment projects in  “Ontustyk” special economic zone” (hereinafter referred to as Procedure) is developed in accordance with the Decree of the President of the Republic of Kazakhstan  N 1605 from 06 July, 2005 «On creation of “Ontustyk” Special Economic Zone» (hereinafter ¬– Decree), “Ontustyk” special economic zone development program for 2007-2015” approved by the Government Regulation N 895 from 21-st of September, 2006 (hereinafter – Program),  Charter of State Authority  “Ontustyk” Special Economic Zone Directorate” (hereinafter – Directorate), and defines the list of documents and information provided to the Directorate, the procedure of consideration and making an expert examination of applications for realization of certain activity and also the requirements for their drawing up.

2.    Basic definitions
“Ontustyk” SEZ  – Special economic zone “Ontustyk”.
Applicant – juridical or physical body - would be for obtaining the status of “Ontustyk” SEZ participant.
Directorate – State Authority “Ontustyk” special economic zone Directorate. 
Council – Council on “Ontustyk” special economic zone development. 
“Ontustyk” SEZ participant – juridical body registered in the territory of “Ontustyk” SEZ.

3.    List of documents and requirements for their registration
3.1.    Applicant whishing  to obtain the status of “Ontustyk” SEZ participant provides Directorate with the following list of documents for consideration:
-    APPLICATION;
-    BUSINESS-PLAN;
3.2.    Directorate provides confidentiality of information under the matter of the project of Applicant and information on results of examination of the project.
3.3.    Applicant takes up responsibility for completeness and reliability of the presented initial data, calculations, substantiations. Representation of incomplete or doubtful data by Applicant is the basis for termination of consideration and rejection of the project.
3.4.    Basic documents should be given on the paper in duplicate.
3.5.    Sources of reception of all initial data and ratings should be specified. For price indexes the date of calculation should be specified.
3.6.    Documents are made out according to standard requirements of registration of business documentation. Text part of the documents should be prepared on standard sheets of paper (standard А4 210х297 mm).
3.7.    Any other information may be given by Applicant on his discretion.

4.    The procedure of consideration of applications on main and additional types of activity
4.1.    Selection of applications is made by following groups of criteria:
•    Manufacture of textile production with use of cotton,
•    Use not less than 30% of local cotton,
•    Creation of vertically organized companies,
•    Manufacture of high quality products,
•    Modern technology,
•    Availability of Strong Market plan,
•    Input of technical know-how and constant improvements of professional skills of specialists.
4.2.    Application is registered in Directorate and registration number is given.
4.3.    Directorate makes the primary checking of the presented documents.
4.4.    Directorate in writing informs Applicant on results of checking. Results of checking are confirmation of application for accordance to declared kind of activity, updating of documents’ registration and also any other recommendations and consultations on further process of application’s consideration.
4.5.    Positive results of primary checking do not guarantee realization of the project in “Ontustyk” SEZ, but it is the basis for the further consideration of application.
4.6.    Term of the primary checking of applications after presenting of all necessary documents and information makes 2 (two) working days.
4.7.    In case of positive results the application is submitted to consideration of Council.
4.8.    Positive conclusion of the Council is the reason for signing of the contract for realization of investment project in SEZ and getting the status of SEZ participant.
4.9.    Procedures of licensing, certification, etc. demanded at realization of any types of activity are made according to the Legislation of RK currently in force.
4.10.    Directorate provides anonymity and confidentiality of examination of the presented applications.

5.    The order of consideration of applications on additional types of activity
5.1.    Consideration of applications on ancillary types of activity according to the Charter is carried out by Directorate.
5.2.    Term of consideration of application on additional types of activity makes 5 (five) working days.
5.3.    One of the following decisions is taken by Directorate after ending of consideration:
- Send application for completion;
- Allow realization of application in “Ontustyk” SEZ;
- Reject further consideration of application.
5.4.    Parties sign the contract with Directorate at positive result of consideration of application.


6.    Legal registration of Applicant
6.1.    Application is supplemented with the documents necessary for registration of company in “Ontustyk” SEZ territory in case of positive conclusion of the Council.
6.2.    It is necessary for applicant to form the legal person who is a subject to registration as “Ontustyk” SEZ participant for realization of activity in “Ontustyk” SEZ territory.
